You can be confident that your personal data are in good hands with us. We believe it is important that it is clear how we handle your personal data. Below we explain exactly how we handle your personal data.

What are personal data?

Personal data are all data that can be traced to you individually, either directly or indirectly, for example, your name, address, date of birth, telephone number and email address, but also your bank account number. Everything that is done to those personal data, for example, collecting, saving, consulting and deleting personal data, is known as processing.

We process the personal data of individuals with whom we have, have had or wish to have, a direct or indirect relationship. Consider, for example:

existing or potential customers and their representatives, such as authorised persons or parents of minors;
visitors to our websites;
individuals affiliated with a company or organisation with which we have a relationship; and
other individuals with whom we have contact.

Whose personal data do we process?

Based on which grounds do we process your data?

We process your personal data based on the following grounds:

to execute a contract;
to fulfil legal obligations;
if you have provided your consent. Good to know: you can simply withdraw your consent at any time. If you withdraw your consent, that only applies as from that point in time; and
to safeguard our legitimate interests, for example, if we have to conduct a risk analysis. In such a case, we would always weigh up your interests against our interests. We will only process your personal data based on this rationale if we find that our legitimate interests outweigh your privacy interests.

Privacy is extremely important to us. These are your data, so you decide. We handle your data carefully and never sell it to others.

We do not process more personal data than necessary and we only process these data for the purposes for which these were collected. We will always save your personal data for as long as required by law. We will then delete your data, except for when there is a good reason for keeping your data for a little longer. For example, when you have submitted a complaint and we are still dealing with this.

How do we guarantee your privacy?

Is Fair Capital Partners allowed to share your personal data with third parties?

We disclose your personal data to third parties only if required for the proper performance of our agreement with you, to comply with applicable laws, or because you have given us permission to do so. We do not share your data with third parties for commercial purposes.

We enter into data processing agreements with companies that process your data within the context of our assignment to ensure an adequate level of security and confidentiality of your data. We remain responsible for the processing of your data. Should it be necessary to pass on your data to third parties outside the EER for the provision of services to you or for the performance of our agreement with you, we shall do so only if an appropriate level of protection can be guaranteed for the protection of your personal data or if a specific derogation applies.

Which rules apply to the processing of personal data?

Legislation and regulations are in place for the protection of personal data. For example, the General Data Protection Regulation (Algemene verordening gegevensbescherming) applies to the whole of Europe, plus the General Data Protection Regulation (Uitvoeringswet Algemene verordening gegevensbescherming) applies in the Netherlands. Other specific rules also apply to certain subjects. For example, the Telecommunications Act (Telecommunicatiewet) applies to the distribution of unsolicited commercial communications and the use of cookies. Also applicable is the Protocol for the Incidents Warning System of Financial Institutions (Incidenten waarschuwingssysteem Financiële Instellingen) (PIFI) to combat fraud and criminality.
